TERMS & CONDITIONS

CONTRACT FOR THE SUPPLY OF PRODUCTS AND SERVICES

The display of goods on the Trackershop site amounts to an invitation to treat only and is not an offer to sell products or services at any price indicated. No contract for the supply of products or goods will be deemed to exist between you and Trackershop unless, and until, an email is sent by Trackershop to you confirming that your order has been accepted and payment has been successfully made. This confirmation e-mail amounts to an acceptance by Trackershop of your offer to buy goods or services from Trackershop and this acceptance is effective regardless of whether or not you receive the e-mail.

Trackershop is free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the availability of the goods or services, or the order itself. Price and availability information is subject to change without notice.

SITE INFORMATION

Trackershop provides this site and its contents on an “as is” basis and makes no representations or warranties of any kind with respect to this site or its contents, except as required by law. To the maximum extent permitted by the Australian Consumer Law and other applicable legislation, Trackershop disclaims all such representations and warranties, including without limitation warranties of merchantability and fitness for a particular purpose. In addition, Trackershop does not represent or warrant that the information accessible via this site is accurate, complete, or current. All prices shown on the website are in Australian dollars (AUD) and inclusive of Goods and Services Tax (GST) at the current rate of 10%, unless otherwise stated.

PROCESSING OF ORDERS

Credit cards are debited before items are shipped or before services are provided by Trackershop.

DELIVERY 

Every effort will be made by Trackershop to post items ordered before 3pm on a working day (Mon-Fri, excluding Bank Holidays) by Couriers. When circumstances deem that this is occasionally not possible Trackershop will post items as soon as absolutely possible and accept no liability for the delay in posting. All deliveries will be made by Courier (Insured) unless specifically requested otherwise. In the event that an item is out of stock or otherwise unavailable Trackershop will contact you and offer you another product, delivery time or a full refund. CANCELLATION OF ORDERS PRIOR TO DELIVERY Orders may be cancelled by phone or email prior to the day of delivery. The cost of the purchase will be refunded to the payment credit/debit card. As payment will have been processed by the credit/debit card services the refund will be made to reflect a cancellation fee of 5% of the initial purchase price. This is to cover our merchant services costs levied as a result of the purchase.

DISTANCE SELLING REGULATIONS/SALE OF GOODS ACT

Any non-business customer wishing to cancel an order under the rights provided by the Distance Selling Regulations/Sale of Gooods Act must do so within 14 days of the point at which the goods were received. The goods must be returned by Signed Delivery (Insured). to : Head Office (AUS):Trackershop PTY LTD. Customers are liable to pay the cost of this return postage. As long as the goods have been returned in original unused condition the cost of the goods will be refunded to the customer’s credit/debit card within 14 days of the date of return. Any actual use of a GPS tracker (switching it on and obtaining tracking information) or other equipment by a customer is a breach of the customers duty to take reasonable care of the product and will negate their right to return under these regulations.

LIMITATION OF LIABILITY (GENERAL)

Except as specifically stated on this site or as required by the Australian Consumer Law, neither Trackershop nor any of its directors, employees, contractors or representatives will be liable for any damages arising out of or in connection with the use of this site or our products. To the fullest extent permitted by law, this limitation of liability applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property, and claims of third parties.

Trackershop, its partners and employees cannot be held liable for damages relating to the cost of any equipment purchased from Trackershop, or consequential costs associated with fitting and operation of the same, where issues arise from the non-availability of mobile network coverage. It is the responsibility of the purchaser to ensure that adequate and appropriate network coverage is available and that the equipment functions effectively at the intended location of use.

Customers intending to use devices outside Australia should verify effective operation before purchasing multiple units. Trackershop will provide reasonable support to assist with such testing. For use beyond one month in a country outside Australia, the customer is responsible for supplying and fitting a suitable data SIM card for the GPS tracker, as well as any costs associated with the use of that SIM card.

Trackershop does not guarantee that its tracking products will operate successfully in all parts of the world. Variations in mobile network technology and coverage make this impossible, and Trackershop accepts no liability for any loss arising from failure of the tracking service. While every effort will be made to assist in setting up tracking, it remains the customer’s responsibility to confirm that network coverage and tracking is possible in any specific location.

ILLEGAL ACTS

It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. We track the electronic ‘fingerprints’ of every order placed on this website to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website. Products purchased from Trackershop may be governed by laws prohibiting their use; it is the sole responsibility of the purchaser/user to comply with these laws and no liability can be implied.

GPS TRACKER AND PRODUCT INSTALLATION

All Trackershop GPS vehicle trackers are supplied on a self-install basis. It is the customer’s responsibility to ensure that installation is carried out correctly and in a manner that does not affect any warranties associated with the vehicle. Trackershop is not responsible for any costs, damage or issues arising from incorrect installation by the customer or a third party.

All tracking subscriptions are managed by the relevant network or service provider. Any subscription issues, data charges or service interruptions are the responsibility of that provider. Trackershop will ensure that you have the necessary contact details for ongoing support.

If the manufacturer of a product purchased from Trackershop ceases trading or Trackershop no longer supplies products from that manufacturer, you are not eligible for a refund.

Refunds are not available for trackers that have been installed and are operational, unless the product is proven to be faulty in accordance with your rights under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify any rights you may have under the Competition and Consumer Act 2010 (Cth) or any other applicable consumer protection laws in Australia.

CHANGES IN TERMS

Trackershop reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on the Trackershop web site. The mapping site is updated and altered periodically without notice.

RETURNS ALL

items purchased from Trackershop are guaranteed for 12 months of use. Due to the nature of this equipment no refunds will be given. If you find that there is a problem with any item please return it to us. We will have it carefully examined and will be happy to replace it if it is found to be faulty. Any obvious physical damage or evidence of other misuse found will naturally nullify this guarantee and offer of replacement.

Any refund made to customers following the return of a tracker (for any reason) will not include any payment made for additional location or SMS credits paid for either at the time of the tracker purchase or after that date. Top up credit purchases will not and cannot be refunded. Any work carried out on behalf of and paid for by clients which involves any custom designing of the mapping panel or other associated features is undertaken by contractors on behalf of Trackershop Australia and payment cannot be refunded upon cancellation once the work is completed, irrespective of any other tracker fault/warranty issue or claim for refund.

The method in which any item is returned is at the discretion of the customer. However we recommend that you return any item(s) via recorded delivery to ensure that it is accounted for through the delivery process.
The cost of returning any item(s) is the full responsibility of the customer. Trackershop are not accountable for any postal costs.

WEBSITE PRODUCT DESCRIPTIONS

1. Equipment Supply

Trackershop Australia reserves the right to supply equipment that may differ in appearance from items shown on the website, provided that the equipment performs the same tracking functions and has equivalent features.

2. Customer Responsibilities

Customers must follow all instructions provided with tracking devices and software.

Trackershop accepts no liability for any loss arising from the customer’s failure to follow such instructions.

The customer is responsible for ensuring that their vehicle, mobile device, and network services are suitable for use with Trackershop products.

3. Limitation of Liability

Except as required by the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)):

Trackershop’s liability in connection with any order (whether in contract, tort, including negligence, or otherwise) shall not exceed the purchase price of the goods or the most recent licence fee paid (for software or mapping panel access).

Trackershop is not liable for any consequential or indirect losses (including, without limitation, loss of profits, business, goodwill, or property damage) arising from use of any tracking product or software, including circumstances where tracking fails or data is lost.

Customers may not bring claims directly against any employee, officer, or contractor of Trackershop.

4. Network and Service Limitations

Trackershop accepts no liability for failure of tracking caused by lack of credit on a customer-supplied SIM card, or any issue with the telecommunications infrastructure on which the tracker depends.

Variations in mobile network technology and coverage may affect tracking. Trackershop does not guarantee that products will operate in all locations.

The customer remains responsible for ensuring that adequate network coverage and data availability exist for the intended use of the tracker.

5. Software and Mapping Panel

The mapping panel and associated software remain the property of Trackershop Australia and can only be used by customers with valid tracking subscriptions or credits purchased through Trackershop.

Trackershop is not liable for losses arising from software faults, mapping errors, or incompatibility with devices that do not meet the stated minimum specifications.

No refunds are available for unused credits except as required by law.

6. Warranties

All warranties implied by law are excluded to the maximum extent permitted, except those which cannot be lawfully excluded under the Australian Consumer Law.

The customer’s sole remedy in the event of a faulty product or service will be as set out in the ACL (repair, replacement, or refund).

7. Accuracy of Information

Whilst every effort is made to ensure accuracy, Trackershop is not responsible for errors in catalogues, website listings, quotations, or other materials. Any recommendations provided in good faith do not form part of a contract and Trackershop accepts no liability for losses arising from reliance on such recommendations.

8. Magnetic Trackers

Magnetic trackers are supplied with strong industrial magnets that have been tested to support the device if properly fitted.

The customer is solely responsible for how and where the product is fitted.

Trackershop is not liable for loss or damage if the device is incorrectly fitted or becomes detached.

TRACKING HISTORY

Tracking History

Tracking history is maintained on the Trackershop Australia mapping server for a period of up to 12 months.

If a tracker is inactive or does not have a valid subscription or credit plan applied, history data may be cleared sooner.

Inactive trackers may be removed from the mapping server at the discretion of Trackershop Australia.

It is solely the responsibility of the customer to save their own tracking history using the export or download facility within the mapping panel.

Trackershop Australia accepts no liability for tracking history lost or deleted from the mapping server, except as required under the Australian Consumer Law.

Service & Network Availability

Trackershop Australia may carry out scheduled maintenance of the tracking panel, which may temporarily affect service availability.

Apart from such maintenance, Trackershop will use reasonable efforts to ensure the panel remains available.

Trackershop Australia is not responsible for any interruptions caused by mobile network providers, telecommunications infrastructure, or factors outside its control.

ACCEPTABLE USE

The Service must not be used for any unlawful, fraudulent, or abusive purpose, and must always be used in compliance with all applicable Australian laws and regulations.

The Service must not be used with SIM cards or tracking devices that have not been supplied by Trackershop Australia, other than standard mobile wireless devices.

The Customer indemnifies Trackershop Australia against any legal liability incurred as a direct result of the Customer’s use or misuse of the Service.

The Customer may permit third parties (including employees or contractors) to access the online tracking service, but this will be entirely at the Customer’s own risk.

All third-party access will be subject to acceptance of Trackershop Australia’s Terms of Use as published on the Trackershop Australia website and updated from time to time.

LOSS OF UNITS 

Magnetic trackers - Trackershop magnetic trackers are tested before despatch and are all equipped with the strongest neodymium magnets available on the market. If installed/attached to the instructions provided by Trackershop the magnets will support the weight of the tracker, when affixed to clean, flat metal. If a unit is lost, due to not fully following these instructions, Trackershop take no responsibility for the costs incurred in replacing a unit.

CANCELLATION BY CUSTOMER

Trackershop Australia may terminate this agreement at any time, without notice, if the Customer breaches these Terms. No contract on these Terms may be terminated by the Customer, except in circumstances in which the Customer has lawfully terminated the contract (or part thereof) under which the device to which these Terms relate was supplied, in accordance with these terms. All other rights of termination which the Customer might otherwise have under the general law are expressly excluded.

DATA CHARGES

The SIM card supplied with your GPS tracker must not be removed from the device. Removal will be treated as misuse and may result in immediate suspension or termination of the service.

Trackershop Australia may monitor SIM card usage to ensure compliance with these Terms.

Equipment may be used in countries covered by the SIM card’s roaming agreements. Prior approval from Trackershop Australia is required, and additional charges may apply for roaming or excessive data usage.

The SIM card provided is a data SIM. To remain active, the tracker must be switched on and obtain a GPS fix at least once every three months. If the device is not used within this period, the SIM card may become inactive and cease to function.

Your tracker requires a valid GPS data plan to obtain position updates. Service interruptions may occur if your plan is inactive or expired.

If Trackershop Australia needs to replace a SIM card, a replacement fee of AUD $65 (incl. GST) applies.

Mapping system access is automatically deactivated if a tracker login has not been used for six months. Reconnection to the mapping system is subject to a fee of AUD $95 (incl. GST).

Nothing in these Terms limits your rights under the Australian Consumer Law.

LOCATION/SMS CREDIT

Location and SMS command credits are not transferrable. And are valid for 1 year from purchase. If products are re-sold by Trackershop Australia customer, the Location and SMS credits linked to the product become void and the new owner must register with Trackershop Australia and purchase new credits.

PORTABLE GPS TRACKER CHARGING PORT

Please be mindful of using the correct charger supplied with your tracking device, as the wrong charger may cause damage to the charging port. Charging port damage is not covered under factory warranty.

LOST/STOLEN SIMS

Customers must notify Trackershop Australia immediately if a SIM card is lost, stolen, or if the Customer suspects (or should reasonably suspect) that the SIM card is being used unlawfully or fraudulently.

The Customer is responsible for all charges incurred up to the time Trackershop Australia receives such notification.

Trackershop Australia requires evidence of loss or theft in the form of a valid Australian Police Report.

Trackershop Australia reserves the right to suspend or terminate service on the tracking panel if it reasonably suspects misuse, fraud, or any unlawful activity.

SIM CARDS AND CALL CHARGES

In conjunction with the supply of tracking devices and provision of our online tracking service, Trackershop Australia may loan SIM cards to customers, subject to these Terms, where call or data credit is purchased through Trackershop Australia.


All SIM cards remain the property of Trackershop Australia and must be returned upon termination of this agreement, however arising.


SIM cards supplied by Trackershop Australia may only be used in Trackershop Australia tracking devices that provide data to Trackershop’s mapping servers. Any other use constitutes a breach of these Terms.

SIM cards supplied with Trackershop devices may have multi-roaming capabilities; however, Trackershop Australia does not guarantee coverage outside Australia.

Customers are solely responsible for checking network coverage and compatibility in their intended area of use, whether within or outside Australia, at the time of purchase or prior to deploying GPS trackers.

Trackershop Australia accepts no liability for inadequate or unavailable mobile network coverage, except as required under the Australian Consumer Law.
